Hull & Machinery Claims

The role of LMA is to promote swift and amicable settlement of claims arising from a marine casualty under different types of Hull & Machinery Insurance forms, such as, Institute Time Clauses – Hulls, American Hull Clauses, Norwegian Hull Clauses, etc., either by preparing a Statement of Adjustment, or giving an opinion on liability under the policy. LMA prepares Statement of Adjustment after collating necessary documentation / information on the incident received from Shipowners, Underwriters, Surveyors and Brokers. In the Statement of Adjustment, all damage repair costs, and incidental expenses are included to achieve settlement of claims in a manner that is fair and equitable to all parties.

LMA provide assistance to clients in administration of Hull and Machinery claims by working in consultation with Marine Engineers, Master Mariners, Nautical and Legal Advisors. LMA also assists in establishing the cause of incident giving rise to loss / damage and, whether such cause is covered within the terms and conditions of insurance policy.  LMA ensures that the Shipowners recover all to what he is entitled, at the same time, ascertains that Underwriters pay nothing more than what they are liable.

  • Compliance of Policy Warranties and Conditions;
  • Computing of Reasonable Cost of Repairs;
  • Necessity and Reasonableness of Temporary Repairs, Generator Hire, etc.;
  • Deferment of Repairs vis-à-vis Cost of Repairs at first available opportunity to Repair;
  • Enhancements and Modifications in Repairs;
  • Removal Expenses and Cost of Riding Repair Team;
  • Extra cost of overtime.
